Who's responsible?
If you’re an employer, manager, occupier or owner of business or other non-domestic premises, you’ll be responsible for fire safety. You’re known as the ‘responsible person’ or “duty holder”.
As the “responsible person / duty holder” you must carry out and regularly review a “fire risk assessment” of the premises. This will identify what you need to do with regards fire precautions and other fire safety duties which are needed to protect and keep people safe.
The “responsible person / duty holder” – particularly in small or low-risk premises - may be able to carry out their own “fire risk assessment”. But if you feel, having read the guidance, that you do not have an appropriate knowledge or understanding of fire safety and the risk to people from fire to comply effectively with the legislative requirements; or, that you are unable to invest sufficient time and resources to do justice to this important task, you will need to appoint a specialist (RELM Consultants Ltd) to carry out the risk assessment for you.
Fire safety legislation in the United Kingdom, The Regulatory Reform (Fire Safety) Order 2005, applies generally to all non-domestic premises. This includes all commercial premises and workplaces, including those managed by voluntary organisations and the self-employed and all premises to which the public have access, including, in England and Wales, the common parts of multi occupied residential buildings such as flats and houses in multiple occupation.
Fire risk assessments
The Regulatory Reform (Fire Safety) Order 2005 replaces 118 pieces of previous fire legislation, including the old fire certificate. The law now shifts responsibility from the fire authorities for fire safety to whoever has day-to-day control of premises i.e. “responsible person / duty holder”.
